Modern MVMT Chiropractic Notice of Privacy Practices and Website Privacy Policy

Effective Date: January 2026


This Notice describes how health information about you may be used and disclosed and how you can access that information. Please review it carefully. Smith – Modern Mvmt Chiropractic Inc. is committed to protecting the privacy of your health information and complying with all applicable federal and state laws, including the Health Insurance Portability and Accountability Act of 1996 (HIPAA).


Our Pledge Regarding Your Health Information


I understand that health information about you and your healthcare is personal, and I am committed to protecting that information. I create and maintain records of the care and services you receive in order to provide you with quality care and to comply with legal requirements. This Notice applies to all records of your care generated by this practice. It explains how I may use and disclose your health information, describes your rights regarding that information, and outlines my legal obligations. I am required by law to ensure that your protected health information ("PHI") is kept private, to provide you with this Notice of privacy practices, and to follow the terms of the Notice currently in effect. I reserve the right to change the terms of this Notice, and any changes will apply to all PHI I maintain about you. Updated Notices will be available upon request, in the office, and on the practice website.


How Health Information May Be Used and Disclosed


Federal privacy regulations allow healthcare providers with a direct treatment relationship to use or disclose PHI without written authorization for purposes of treatment, payment, and healthcare operations. I may use or disclose your PHI to provide, coordinate, or manage your care, including consultations with other licensed healthcare providers or referrals for treatment. Disclosures for treatment purposes are not limited to the minimum necessary standard, as full access to relevant information may be required to provide quality care.

I may also use and disclose your PHI for billing and payment purposes, including collecting payment from you for services rendered, and for healthcare operations such as quality assessment, administrative activities, and business management.

If you are involved in a lawsuit or dispute, I may disclose health information in response to a court or administrative order. I may also respond to subpoenas or lawful requests when required, provided that appropriate efforts have been made to notify you or obtain protective orders as required by law.


Uses and Disclosures That Require Your Authorization


Certain uses and disclosures of your PHI require your written authorization. This includes the use or disclosure of session notes, except in limited circumstances such as use for your treatment, training or supervision of associates, defense in legal proceedings initiated by you, health oversight activities, or as otherwise required by law. I do not use or disclose PHI for marketing purposes, nor do I sell PHI in the regular course of business.


Uses and Disclosures That Do Not Require Authorization


Subject to legal limitations, I may use or disclose your PHI without authorization when required by state or federal law; for public health activities such as reporting abuse or preventing serious threats to health or safety; for health oversight activities including audits and investigations; for judicial or administrative proceedings; for law enforcement purposes; to coroners or medical examiners; for research purposes; for specialized government functions; and for workers’ compensation claims. I may also use or disclose PHI to provide appointment reminders or to inform you of treatment alternatives or health-related services offered by this practice.


Uses and Disclosures Where You May Object

Unless you object, I may disclose your PHI to family members, friends, or others involved in your care or payment for your care. In emergency situations, consent may be obtained retroactively.

Information We Collect


Modern MVMT Chiropractic may collect personal information that you voluntarily provide when scheduling appointments, completing intake forms, contacting our office, subscribing to communications, or receiving services. This information may include your name, phone number, email address, mailing address, date of birth, insurance information, payment information, and health information necessary to provide care and administer services.

• Telephone calls and voicemail messages
• SMS/text message communications
• In-person visits and consultations

SMS/Text Messaging Communications


If you provide your mobile phone number, you may receive SMS/text messages from Modern MVMT Chiropractic related to appointment scheduling, appointment reminders, treatment follow-ups, office updates, and other healthcare-related communications.

Message frequency may vary. Message and data rates may apply depending on your mobile carrier and service plan.


You may opt out of receiving SMS messages at any time by replying STOP to any text message. For assistance, reply HELP or contact our office directly.

Information Sharing and Protection

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.


Text messaging originator opt-in data and consent will not be shared with any third parties except vendors or service providers necessary to provide messaging services or as required by law.


We do not sell, rent, share, or transfer consumer personal information, including mobile opt-in data and consent, to external organizations under any circumstances except as required by law.


Personal information may be shared only with service providers, business associates, payment processors, healthcare providers involved in your care, or as otherwise required or permitted by law.


We maintain administrative, technical, and physical safeguards designed to protect personal information and protected health information from unauthorized access, use, or disclosure.


Your Rights Regarding Your Protected Health Information


You have the right to request restrictions on how your PHI is used or disclosed for treatment, payment, or healthcare operations, although I am not required to agree to such requests if they may affect your care. You also have the right to request restrictions on disclosures to health plans for services you have paid for out-of-pocket in full. You may request that communications be sent to you in a specific way or location, and reasonable requests will be accommodated.


You have the right to inspect and obtain a paper or electronic copy of your medical records, excluding session notes, within 30 days of submitting a written request. A reasonable, cost-based fee may apply. You have the right to request an accounting of certain disclosures of your PHI made within the past six years, excluding disclosures for treatment, payment, or healthcare operations. You also have the right to request corrections or updates to your PHI if you believe it is inaccurate or incomplete. Requests must be made in writing, and you will receive a written response within 60 days.

You have the right to receive a paper or electronic copy of this Notice at any time, even if you previously agreed to receive it electronically.


Record Retention and Security


Patient records are retained for a minimum of seven (7) years following the date of your last visit, as required by law. Smith – Modern Mvmt Chiropractic Inc. maintains physical, administrative, and technical safeguards to protect your PHI and limits access to those individuals who need the information to perform their job responsibilities.


Questions, Complaints, and Changes to This Notice


If you believe your privacy rights have been violated or you disagree with a decision regarding access to your records, you may file a complaint with the practice or with the U.S. Department of Health and Human Services. There will be no retaliation for filing a complaint. This practice reserves the right to change this Notice, and material changes will be provided to you and will include a new effective date.
